The future of flavoured vaping products in Canada has been a topic of ongoing debate since 2021. Here's where things stand as of 2026.
The Current Status: Flavoured Vapes Are Still Legal in Canada
As of April 2026, there is no federal ban on flavoured vaping products in Canada. Flavoured e-liquids, flavoured disposable vapes, and flavoured pods remain legal for sale across the country, including in Ontario. All nicotine vaping products are capped at 20mg/mL concentration under existing federal regulations, but flavour itself is not restricted at the federal level.
This means you can still purchase fruit, dessert, candy, menthol, and tobacco-flavoured vaping products legally in Ontario and most other provinces.
What Health Canada Has Proposed
Health Canada first signalled interest in flavour restrictions in 2021, when it published a consultation proposing to limit vaping product flavours to tobacco, mint, and menthol only. The stated goal was to reduce the appeal of vaping products to youth while maintaining access for adult smokers seeking alternatives to cigarettes.
Since then, the federal government has not enacted the proposed ban. The consultation period generated significant feedback from the vaping industry, harm reduction advocates, public health groups, and consumers. The result has been a more cautious approach that considers the potential unintended consequences of eliminating flavours entirely.
Arguments For and Against Flavour Restrictions
Those supporting restrictions argue that flavoured products appeal disproportionately to youth and contribute to non-smokers taking up nicotine consumption. They point to youth vaping statistics and the wide variety of candy and fruit flavours as evidence that the market targets younger users.
Those opposing restrictions argue that flavoured products are essential for adult smokers transitioning away from cigarettes. Research consistently shows that adults who switch from smoking to vaping overwhelmingly prefer non-tobacco flavours. Removing these options could push former smokers back to cigarettes or toward unregulated black market products.
The harm reduction argument is particularly relevant in Canada, where vaping is positioned as a less harmful alternative to smoking rather than being treated identically to tobacco products.
Provincial Approaches Vary
While the federal government has not banned flavours, individual provinces have the ability to implement their own restrictions:
Ontario: Has not implemented a provincial flavour ban. Flavoured vaping products remain fully available for purchase by adults 19+.
Nova Scotia: Restricted flavoured vaping products in 2020, limiting legal sales to tobacco, mint, and menthol flavours only. This was one of the first provincial flavour restrictions in Canada.
Prince Edward Island: Also implemented flavour restrictions.
Other provinces: Most provinces, including British Columbia, Alberta, Quebec, and Manitoba, have not implemented blanket flavour bans as of 2026, though regulations continue to evolve.
What This Means for Ontario Vapers
For vapers in Ontario and across most of Canada, the full range of flavoured vaping products remains available and legal. However, the regulatory landscape can change, and it's worth staying informed about any new proposals from Health Canada or the Ontario provincial government.
