TERMS AND CONDITIONS

A RECORD OF YOUR NYX MEMBERSHIP ACCOUNT AND AN ORIGINAL RECEIPT MUST BE PRESENT WHEN RETURNING OR EXCHANGING ANY PRODUCT.

NYX ECIGS Inc. is not liable for any damage(s) or injury(s) caused by the use of products we may sell. By making a purchase, the user acknowledges full responsibility and understands all associated risks. Our products are intended for individuals aged 19+. We advise customers to conduct thorough research before purchasing. NYX ECIGS Inc. does not manufacture any of the products we may sell.

Any products purchased from NYX ECIGS that fall within the product categories are covered under our Warranty Policy will undergo inspection by NYX ECIGS staff.  All qualifying terms as they pertain to NYX ECIGS’ Warranty Policy must be met:

  • Original receipt must be presented. 
  • The warranty claim is filed within 30 days of the original purchase date. 
  • The product's original packaging (box) must be present, with all original contents in the box. 
  • There are no physical damages on the product (including liquid damage, damage as a result of misuse, alteration/modification to the device, or wear and tear)

For an exchange, credit, or refund, the product (s) under inspection must be deemed defective after close observation by NYX ECIGS staff.

Products subject to our Warranty policy will have a limitation of only one exchange, issue of credit, or refund after a Warranty Claim is opened, processed, and finalized by NYX ECIGS staff. 

Any exchanges, credits, or refunds provided will be in the form of store credit and recorded accordingly. Your NYX ECIGS account may be flagged due to frequent returns and/or exchange activity associated with or without Warranty Claims. If you feel that your account has been mistakenly flagged, please contact support@nyxecigs.com for assistance.


RETURN POLICY

Upon purchasing from NYX E-CIGS INC., you confirm that you are at least 19+. All shipments are dispatched with a requirement for a signature and a valid government-issued ID. Once your age is successfully verified upon delivery of your order, subsequent orders will not require a signature. If proof of age cannot be verified, NYX E-CIGS INC. is not responsible for additional fees incurred for packages being returned to the sender. We will charge a flat rate of $15 for the restocking fee and the shipping cost, even if your order was eligible for free shipping.

 

NYX ECIGS does not offer refunds, store credit, exchanges, or warranty for the following items:

  • Warranty issues must be resolved directly with the manufacturers.
  • Opened and/or used E-liquids
  • Opened and/or used Disposable Vape Products
  • Opened and/or used STLTH Pods
  • Opened and/or used Replacement Coils, Replacement Pods, Clearomizers, Cartomizers, Atomizers, Leaking, spitting, or burning experienced with Coils, Pods, Clearomizers, Cartomizers, or Atomizers. 
  • Misused, damaged, or broken starter kits or parts.
  • We do not offer returns, store credit, or refunds for any purchase of batteries (18350, 18650, 20700, 21700, 26650). We may offer an exchange for any batteries deemed defective after close inspection.
  • Used or Unused Vaporizers for dry herbs and/or concentrates [FINAL SALE].

 

Purchases of these products are not eligible for exchange or return. If we receive any items listed above, they will be discarded. No exchanges, store credits, or refunds will be issued for returns of the above products.

If the original outer packaging is opened, products returned are subject to a 20% Restocking Fee (limitations may apply).

  • All disposable vapes, e-liquids, and STLTH pod purchases are final sale. 
  • Warranty for Disposable Vapes is only valid if the device is not working directly from the packaging. We encourage customers to try their disposable vape devices before leaving the store. 
  • Misused, damaged, or broken starter kits or parts will not be refunded.
  • Returned items to NYX E-CIGS INC. will be carefully inspected upon receipt. No credit or refund will be given if there are clear signs of the Return Policy Terms and Conditions being abused.
  • Shipping costs are non refundable.
  • Warranties and RMA on mods and devices are 30 days from the date of purchase. Original receipt must be presented with no physical damage on the device to qualify for warranty. If the item is DOA (dead on arrival), we will replace it after it has been deemed defective by a staff member. If you need a return merchandise form, please email support@nyxecigs.com
  • Vaporizers for dry herbs and/or concentrates are final sale; warranty issues must be resolved directly with the manufacturers.
  • Warning! Avoid using damaged insulation covers on batteries in any NYX ECIGS INC products. NYX ECIGS INC cannot be held liable for any damages resulting from the use of inferior batteries. Mishandling these devices poses a significant risk and may lead to irreversible harm. NYX ECIGS INC strongly advises customers to handle these products with care

All returned merchandise must be received in our Markham office within seven days of the original receiving date. Please ensure you return your order via trackable mail, as we do not take any responsibility for undelivered returns. Please contact support@nyxecigs.com with any further questions.

 

TO PROCESS YOUR RETURN

Please email support@nyxecigs.com or contact our customer service at 855-699-3244 extension 0 for the Return Merchandise Form.

Please ship the items back to NYX E-CIGS INC. at the address indicated on the Return Merchandise Form using a trackable shipping method. Shipping costs will be at the sender’s expense. NYX E-CIGS INC. is not responsible for shipping costs incurred for returned merchandise.

Please allow 1-2 weeks for processing, depending on when we receive your items at our Markham office. All refunds will be issued as a store credit.

HOW OUR SAME-DAY DELIVERY SERVICES WORK

 

  • Same-day delivery services will be available Monday to Friday (weather permitting)
  • We do not offer this service on weekends and holidays.  
  • Orders must be placed before 12:00 pm.
  • Orders over $50 (Excluding taxes and discounts) will be eligible for this service
  • Select “local delivery” on the checkout page to receive this service. 
  • Orders placed after the cutoff time will be delivered on the next BUSINESS day. 
  • This service is only available for residential addresses 
  • We do not offer this service to commercial/business addresses
  • Only age-verified customers have the option to provide delivery instructions
  • We are not responsible for lost and/or damaged products 
  • Customers living in condos or apartments must meet the driver in the lobby 
  • A restocking fee of $15 will apply for any returned packages. 

 

ID VERIFICATION

In compliance with the Smoke-Free Ontario Act, you must present a valid government identification to verify your age upon package delivery. Our courier will inspect the ID before releasing your package. For any inquiries, you can contact us at support@nyxecigs.com.

 

Same-Day Delivery FAQs

 

Who will be delivering my same-day order?

Our delivery partners provide same-day delivery in specific regions across the GTA. Please ensure you are present to receive your order. Please note that we cannot guarantee the exact delivery time.

 

Can I select the delivery time? 

Unfortunately, you can not request a specific delivery time. 

 

What if I am not available when the delivery partner arrives?

If our delivery partner attempts delivery but you are unavailable and a secure location for your order cannot be found, they may attempt to contact you using the phone number provided during checkout. If the delivery cannot be completed, your order will be returned to us.

The store will process a PARTIAL refund of your order within 24–72 hours of its return. Depending on your bank’s processing time, it may take up to 10 days after we process the return to reflect on your account. Please note a flat $15 restocking fee will apply.

 

Is there a minimum for Same-Day Delivery?

Yes, Orders over $50 (Excluding Taxes and Discounts) will be eligible for Same-Day Delivery.

 

How will I know the driver is on the way?

You will receive a confirmation email when we receive your order and another once it is en route to your location. Utilize the real-time GPS tracker to stay updated on the latest notifications regarding your Same-Day Delivery order. For additional assistance, you may also use the “Help” option to contact the courier’s customer service. Alternatively, feel free to contact us at support@nyxecigs.com

 

Why was my Same-Day Delivery order delivered the next day?

If your order is placed after the local cutoff time, it will be delivered on the next available day.

 

What can I do if I enter the wrong address on my Same-Day Delivery order?

If you entered the wrong address on your Same-Day Delivery order, you have 30 minutes before the cut-off time to contact support@nyxecigs.com.
Reminder: our cut-off time is at 12:00 pm. 

 

Who will be delivering my Same-Day Delivery order?

We offer Same-Day Delivery through our delivery partners in select areas across the GTA. We recommend that you be home to receive your order.

 

Can I cancel a Same-Day Delivery order?

You must contact support@nyxecigs.com before 12:00 PM. Orders canceled after the cut-off time will be subject to a flat rate of $15 restocking fee. 

 

Can I add something to my Same-Day Delivery order?

Once your order has been placed, you may not add additional items to your Same-Day Delivery order.

 

What is scheduled for Same-Day Delivery?

Typically, orders will arrive between 4:00 PM and 10:00 PM. Please note that we cannot guarantee specific delivery times or accommodate special requests. Additionally, this service is not available for businesses or commercial locations.

 

My order delivery window has passed, and my order has not arrived. What should I do?

We apologize for the inconvenience. Please contact the courier’s customer service via https://www.alwaysot.com/ and support@nyxecigs.com

 

Will there be a second delivery attempt? 

No, we do not provide multiple delivery attempts. If you are unavailable to receive the order, the package will be returned to us by the third-party courier. We will then issue a partial refund within 48 hours, with a $15 restocking fee applied. Please note that exceptions to this policy may be considered in specific situations.
