Canada's vaping regulations have evolved significantly since the Tobacco and Vaping Products Act (TVPA) was introduced in 2018. Whether you're new to vaping or just want to make sure you're up to date, this guide covers every major regulation that affects vapers in Ontario and across Canada in 2026.
Federal Vaping Laws in Canada
These laws apply across all Canadian provinces and territories:
Nicotine concentration limit: 20mg/mL. Since July 2021, all vaping liquids sold in Canada are capped at 20mg/mL nicotine concentration. This applies to both bottled e-liquid and pre-filled disposable devices. Products exceeding this limit cannot be legally sold in Canada.
No sales to minors. It is illegal to sell or provide vaping products to anyone under the age of 18 at the federal level. Many provinces, including Ontario, set the minimum age higher at 19.
Advertising restrictions. Vaping product advertising is restricted in Canada. Lifestyle advertising that could appeal to young people is prohibited, and all advertising must include health warnings. Vape products cannot be promoted in ways that associate them with a glamorous lifestyle.
Packaging and labelling. Health warnings are mandatory on all vaping product packaging. Specific information about nicotine content and ingredients must be displayed.
Flavour regulations. As of 2026, Canada has not implemented a federal ban on flavoured vaping products, though this continues to be debated. Flavoured e-liquids and disposable vapes remain legal for sale across the country.
Ontario-Specific Vaping Laws
Ontario has implemented additional provincial regulations under the Smoke-Free Ontario Act, 2017 (SFOA):
Legal age: 19. In Ontario, you must be 19 years or older to purchase vaping products. This is stricter than the federal minimum of 18. Retailers must verify age at the point of sale and upon delivery for online orders.
Where you can vape. Ontario prohibits vaping in the same places where smoking is banned, including enclosed workplaces, enclosed public spaces, schools and school grounds, hospitals and healthcare facilities, outdoor areas of restaurants and bars, playgrounds and sports fields, and within 9 metres of building entrances and exits for public spaces.
Vape shop display rules. Ontario permits vape shops to display products, but there are restrictions on visibility from outside the store. Products and promotional materials should not be visible to people who have not entered the store.
Online sales. Online sales of vaping products to Ontario residents are legal, provided the retailer verifies the purchaser's age. At NYX Vape, we verify age at checkout and upon delivery to ensure compliance.
What About Flavour Bans?
Flavour restrictions are one of the most discussed topics in Canadian vaping regulation. Here's where things stand in 2026:
At the federal level, Health Canada has considered restricting flavoured vaping products but has not implemented a blanket ban. Consultations and proposals continue to evolve.
At the provincial level, some provinces have implemented or proposed flavour restrictions. Ontario has not enacted a provincial flavour ban as of April 2026, meaning flavoured vaping products remain available for purchase.

Travelling with Vapes in Canada
If you're travelling within or outside Canada with vaping products, keep these rules in mind:
Domestic flights: Vaping devices must be carried in your carry-on baggage, not in checked luggage (due to lithium battery regulations). E-liquid containers must comply with the standard 100mL liquid carry-on rule. You cannot vape on any Canadian domestic flights.
International travel: Vaping regulations vary dramatically by country. Some countries (like Thailand, Singapore, and India) have outright bans on vaping products, and possession can result in fines or criminal charges. Always research your destination's laws before travelling with vaping products.
Driving: There is no specific law prohibiting vaping while driving in Ontario, but if it impairs your ability to see the road (due to vapour), you could be charged under distracted driving laws.
