Age Verification Policy

NYX Vape INC. ("NYX," "we," "us") sells vapour products, e-liquids, and related accessories. Canadian federal and provincial laws prohibit the sale of these products to anyone below the legal age of majority for vaping products in their province or territory of residence. This Age Verification Policy explains how we verify age online and in store, and what you should expect during the purchase and delivery process.
1. Legal age requirement
The federal minimum age for the sale of vaping products under Canada's Tobacco and Vaping Products Act (TVPA) is 18. Most provinces and territories have set a higher minimum. The legal age for the purchase of vaping products in each jurisdiction in Canada is as follows:
- 18 years — Alberta, Manitoba, Northwest Territories, Quebec
- 19 years — British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, Nunavut, Ontario, Saskatchewan, Yukon
- 21 years — Prince Edward Island
The age applicable to you is the age set by the province or territory where you reside and receive delivery. In Ontario, where NYX's primary retail operations are based, the age requirement of 19 is established by the Smoke-Free Ontario Act, 2017. By placing an order or entering a NYX retail store, you represent and warrant that you meet the legal age requirement for your jurisdiction.
2. Website age gate
When you first visit www.nyxecigs.com, you must confirm that you are of legal age before you can browse products. If you indicate that you are below the legal age for your province or territory, you will be redirected away from our site. The age gate is a first-line screen, not a substitute for verification. Every order is independently verified at delivery.
3. Account creation and checkout
When you create a customer account or place an order, we collect your date of birth, full legal name matching a valid government-issued photo ID, and a verifiable shipping address. We reserve the right to refuse, cancel, or refund any order where the information provided appears inaccurate, inconsistent, or suggests the purchaser is under the applicable legal age.
4. Age verification at delivery (online orders)
Every online order shipped by NYX requires signature at delivery and valid government-issued photo ID. The person accepting the delivery must:
- Be the named recipient on the order, or an adult member of the same household who meets the legal age of majority for vaping products in that province or territory.
- Present valid, unexpired government-issued photo identification showing their date of birth.
- Sign for the package to confirm receipt.
We follow the identification list prescribed by federal Tobacco (Access) Regulations, Section 2, as a business-policy standard for vaping sales. Acceptable IDs include:
- A provincial or territorial driver's licence
- A Canadian passport
- A Canadian citizenship certificate bearing a photograph
- A Canadian permanent resident document
- A Canadian Armed Forces identification card
- A Secure Certificate of Indian Status
- Any other document issued by a federal, provincial, or foreign government containing the person's name, photograph, date of birth, and signature (for example, a provincial photo-ID card)
We note that the Tobacco (Access) Regulations were enacted primarily for tobacco products; we apply the same ID standard to vape sales by choice, to maintain a consistent and defensible verification practice.
Our delivery partners (Canada Post, Purolator, UberDirect, and others) are instructed not to release packages if:
- The recipient cannot produce acceptable photo ID;
- The ID indicates the recipient is under the legal age for that province or territory; or
- The recipient appears impaired or otherwise unable to provide valid consent.
If delivery is refused for any of these reasons, the package will be returned to NYX. We will refund the order in accordance with our Return Policy, less original shipping and return-shipping costs where applicable.
5. Age verification in retail stores
Our store associates verify the age of every customer who purchases vapour products in a NYX retail location, regardless of apparent age. Acceptable ID is the same list set out in Section 4. Expired ID, photocopies, photographs of ID, school cards, and non-photo ID are not accepted. A customer who cannot produce valid ID will be refused service. This is a legal requirement, not a discretionary decision.
6. Underage orders and attempted misrepresentation
If we identify at any stage — age gate, checkout, delivery, or after — that an order was placed by a person under the applicable legal age or using false identification, we will:
- Immediately cancel any undelivered portion of the order and issue a refund to the original payment method, less shipping and handling for any portion already dispatched;
- Flag the associated account, email address, phone number, and shipping address to prevent future orders;
- Cooperate with any investigation by Health Canada, a provincial public health authority, or law enforcement.
Providing false information about your age or using another person's identification violates our Terms of Service and may be an offence under Canadian federal or provincial law.
7. Parental and guardian notice
If you are the parent or guardian of a minor and believe they may have purchased or attempted to purchase products from us, please contact our customer service team at support@nyxecigs.com. We will assist with order cancellation, refund, and account suspension as appropriate.
8. Record keeping
We retain age-verification records — including order-level confirmation that ID was presented and accepted at delivery — for up to 2 years from the date of sale. This retention period is a business-practice decision: neither the federal Tobacco and Vaping Products Act nor Ontario's Smoke-Free Ontario Act, 2017 prescribes a specific retention period for retailer age-verification records. We keep these records long enough to respond to a regulatory inquiry from Health Canada, a provincial public health authority, or an inspector acting under provincial authority, while respecting PIPEDA's principle of limiting retention to what is necessary. Records are protected in accordance with our Privacy Policy and accessed only by authorized staff or in response to a lawful request from a regulatory authority.
9. Promotions, contests, and marketing
NYX does not market vapour products to anyone below the applicable legal age of majority. We comply with the federal Vaping Products Promotion Regulations (SOR/2020-143) and Part IV.1 of the Tobacco and Vaping Products Act, which together prohibit:
- Promotion that is done in a manner that can be seen or heard by young persons;
- Lifestyle advertising and advertising appealing to young persons;
- Testimonials and endorsements;
- Sponsorship promotion;
- The use of flavour descriptors that may be appealing to young persons.
Our marketing content is age-gated across email, SMS, and online advertising; subscribers must confirm they meet the applicable legal age of majority at signup. Health warnings accompany permitted vaping advertising as required by the Regulations.
10. Reporting concerns
If you believe a NYX retail location, a delivery partner, or our website has failed to enforce age verification appropriately, please contact our Compliance team at compliance@nyxecigs.com. Reports are taken seriously and investigated promptly.

12. Changes to this policy
We may update this Age Verification Policy from time to time to reflect changes in Canadian federal or provincial law or our business practices. The "Last updated" date at the top of this page shows when the policy was last revised.
